O artigo pretende contribuir com as discussões sobre o ensino de filosofia, partilhando achados de uma pesquisa realizada com duas turmas de estudantes universitários na disciplina de Estética (Curso de Música -Licenciatura). As inovações metodológicas aplicadas nas turmas buscaram valorizar o ensino de filosofia em diálogo permanente com as vivências cotidianas e artísticas dos estudantes através de atividades em sala sistematicamente vinculadas aos temas previstos no programa da disciplina. Os resultados dos dados apontaram que as estratégias metodológicas de ensino utilizadas (...) na disciplina tiveram impacto positivo para o engajamento dos discentes, atuando desenvolvimento de sua criticidade e criatividade. Supervenience is one of the 'hot discoveries' of analytic philosophy, and this collection of essays on the topic represents an examination of it and its application to major areas of philosophy. The interest in supervenience has much to do with the flexibility of the concept. To say that x supervenes on y indicates a degree of dependence without committing one to the view that x can be reduced to y. Thus supervenience is a relationship that has the potential of replacing (...) the traditional notion of dependence, while performing at least part of the function reductive relationships were supposed to fulfil. Ever since the early days of quantum mechanics it has been suggested that consciousness could be linked to the collapse of the wave function. However, no detailed account of such an interplay is usually provided. In this paper we present an objective collapse model where the collapse operator depends on integrated information, which has been argued to measure consciousness. By doing so, we construct an empirically adequate scheme in which superpositions of conscious states are dynamically suppressed. Unlike other proposals in (...) which “consciousness causes the collapse of the wave function,” our model is fully consistent with a materialistic view of the world and does not require the postulation of entities suspicious of laying outside of the quantum realm. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. In a time marked by the development of innovative treatments in healthcare and the need for health professionals to deal with resulting ethical dilemmas in clinical practice, this study was developed to determine the influence of the bioethics teaching on the moral competence of medical and nursing students. The authors conduct a longitudinal study using the Moral Competence Test extended version before and after attending the ethics curricular unit, in three nursing schools and three medical schools of Portugal. In this (...) questionnaire the participant is confronted with three ethical dilemmas and asked to evaluate arguments for and against the attitude of the main character. For both nursing and medical students, C-score was lower after the attendance of the ethics curricular units, with a statistically significant decrease in the total score for nursing students and a decrease not statistically significant for medical students. A multivariate analysis did not find any association between this decrease and gender, course, or age. The phenomenon of moral segmentation was observed, with better performance in the worker and judge dilemma, than in the doctor dilemma. These results highlight the need to reflect on the curricular strategies that can be implemented for health professionals to better develop moral competence and decision-making, allowing for the provision of humanized health care. Metaphysical anti-realism is a large and heterogeneous group of views that do not share a common thesis but only share a certain family resemblance. Views as different as mathematical nominalism—the view that numbers do not exist—, ontological relativism—the view that what exists depends on a perspective—, and modal conventionalism—-the view that modal facts are conventional—all are versions of metaphysical anti-realism. As the latter two examples suggest, relativist ideas play a starring role in many versions of metaphysical anti-realism. But what does (...) it mean for the existence of something to “depend on” a perspective, or for a modal fact to “depend on” a convention? We can distinguish between various dependence relations, giving rise to an array of drastically different forms of metaphysical anti-realism. This article offers a guided tour. I develop a systematic distinction between various forms of metaphysical anti-realism with a focus on the role of relativist ideas in this landscape. (shrink)

Its editors and contributors ask, “Where is psychoanalysis in contemporary thought?” At a time when the empirically based psychologies have long repudiated (...) the “talking cure” to the extent that the unconscious is not visible or easily measured, and when, on the other hand, psychoanalysis has been associated in the humanities with a radical political and social agenda, disappointed hopes for change have led many to throw the baby of psychoanalysis out with the bathwater of a utopian vision of transformation. The question now remains: “Whither psychoanalysis?” To answer this question (which is also a demand), the editors first acknowledge that the critique and curtailing of psychoanalytic thought in the cultural studies programs across the country in the last decade or so has been influenced by the works of Michel Foucault, his disciples, and the New Historicism. At the same time, they believe that the political, psychological, and moral dangers of embracing a knowing and cynical postmodernism that fosters hollow consumerism premised on modes of subjectivity that “neither ‘express’ interiority nor bear any relation to a lived past” are a real and present danger in contemporary life. “That the triumph of such a view has coincided with intellectuals’ renewed suspicion of psychoanalysis should, we believe, give us pause” (8). The essays that constitute the present volume thus insist on the persistence of the desire of the analyst: for knowledge of self and other, and by those who long for interpretive insight into interior lives and social places. The volume thus poses for its readers twin questions: “Why do we continue to desire psychoanalysis, and what should its role be in the cultural criticism of the new millennium?”This collection grew out of a conference organized around this question and thus reflects the varied but not necessarily interconnected papers offered in that setting. In an effort to provide some interconnections, the collection is divided into four sections grouped around the topics of psychoanalysis and the future of cultural criticism, collectivity, the author, and sexuality. The grouping does not, in my estimation, provide unity or coherence to the volume as a whole; nevertheless, each article emerges on its own terms as a strong contribution to the general field of psychoanalytic cultural criticism and critical theory. Henry Sussman’s “Psychoanalysis, Religion, and Cultural Criticism at the Millennium” provides an anchoring perspective to the volume, addressing with particular urgency the mutually transformative desire of and for analysis modeled on the transference/countertransference clinical encounter. This analogy [End Page 153] suggestively sets the stage for a like transformative intervention by the analyst in a cultural critique, while acknowledging that cultural studies provides the best interpretation and assessment of the ways that psychoanalysis operates historically and clinically in contemporary society. Sussman—and indeed many of the contributors—underscores the editors’ organizing declaration that since psychoanalysis derived from lived human experience it stands to reason that “analysis is both the product of and answer to suffering” (15).Thus it comes as something of a surprise that one of its editors, Greg Forter, in “F. Scott Fitzgerald, Psychobiography, and the Fin-de-Siecle Crisis in Masculinity,” locks the subject of psychoanalysis into a stranglehold with his presuppositions about the limits of history and the origins of psychoanalysis in the modern moment: “Because the theory and techniques of psychoanalysis were developed by analyzing modern men and women, psychoanalysis may be a theory of modern subjectivity rather than of subjectivity as such, and its mode of inquiry may be best suited to analyzing the phenomena of modernity” (148). The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

Cause and effect relationships play a central role in how we perceive and make sense of the world around us, how we act upon it, and ultimately, how we understand ourselves. Almost two decades ago, computer scientist Judea Pearl made a breakthrough in understanding causality by discovering and systematically studying the “Ladder of Causation” [Pearl and Mackenzie 2018], a framework that highlights the distinct roles of seeing, doing, and imagining. In honor of this landmark discovery, we name this the Pearl (...) Causal Hierarchy (PCH). In this chapter, we develop a novel and comprehensive treatment of the PCH through two complementary lenses, one logical-probabilistic and another inferential-graphical. Following Pearl’s own presentation of the hierarchy, we begin by showing how the PCH organically emerges from a well-specified collection of causal mechanisms (a structural causal model, or SCM). We then turn to the logical lens. Our first result, the Causal Hierarchy Theorem (CHT), demonstrates that the three layers of the hierarchy almost always separate in a measure theoretic sense. Roughly speaking, the CHT says that data at one layer virtually always underdetermines information at higher layers. Since in most practical settings the scientist does not have access to the precise form of the underlying causal mechanisms – only to data generated by them with respect to some of PCH’s layers – this motivates us to study inferences within the PCH through the graphical lens. Specifically, we explore a set of methods known as causal inference that enable inferences bridging PCH’s layers given a partial specification of the SCM. For instance, one may want to infer what would happen had an intervention been performed in the environment (second-layer statement) when only passive observations (first-layer data) are available. We introduce a family of graphical models that allows the scientist to represent such a partial specification of the SCM in a cognitively meaningful and parsimonious way. Finally, we investigate an inferential system known as docalculus, showing how it can be sufficient, and in many cases necessary, to allow inferences across PCH’s layers. We believe that connecting with the essential dimensions of human experience as delineated by the PCH is a critical step towards creating the next generation of AI systems that will be safe, robust, human-compatible, and aligned with the social good. Confidentiality is a central bioethical principle governing the provider–patient relationship. Dating back to Hippocrates, new laws have interpreted it for the age of precision medicine and electronic medical records. This is where the discussion of privacy and technology often ends in the scientific health literature when Internet-related technologies have made privacy a much more complex challenge with broad psychological and clinical implications. Beyond the recognised moral duty to protect patients’ health information, clinicians should now advocate a basic right to privacy (...) as a means to safeguard psychological health. The article reviews empirical research into the functions of privacy, the implications for psychological development and the resigned sentiment taking hold regarding the ability to control personal data. The article concludes with a call for legislative, educational and research steps to readjust the equilibrium between the individual and ‘Big Data’. (shrink)

We show that in the Maxwell–Lorentz theory of classical electrodynamics most initial values for fields and particles lead to an ill-defined dynamics, as they exhibit singularities or discontinuities along light-cones. This phenomenon suggests that the Maxwell equations and the Lorentz force law ought rather to be read as a system of delay differential equations, that is, differential equations that relate a function and its derivatives at different times. This mathematical reformulation, however, leads to physical and philosophical consequences for the ontological (...) status of the electromagnetic field. In particular, fields cannot be taken as independent degrees of freedom, which suggests that one should not add them to the ontology. (shrink)

This article contributes to the literature on national varieties of socially responsible investment (SRI) by demonstrating how Scandinavian SRI developed from the 60s and onwards. Combining findings on Scandinavian SRI with insights from previous research and institutional theory, the article accounts for the role of changes in societal values and norms, the mechanisms by which SRI practices spread, and how investors adopt and transform practices to suit their surrounding institutional contexts. Especially, the article draws attention to how different categories of (...) investors act as institutional entrepreneurs during specific historical periods, and how these roles come to shift as institutional rule systems of varying societal levels change. Thus, the insights gained are useful in the future research agenda concerned with advancing knowledge on idiosyncrasies and commonalities of national SRI manifestations, and to understand the reasons underlying such characteristics. Health care often involves ethically difficult situations that may disquiet the conscience. The purpose of this study was to develop a questionnaire for identifying various perceptions of conscience within a framework based on the literature and on explorative interviews about perceptions of conscience (Perceptions of Conscience Questionnaire). The questionnaire was tested on a sample of 444 registered nurses, enrolled nurses, nurses’ assistants and physicians. The data were analysed using principal component analysis to explore possible dimensions of perceptions of conscience. The (...) results showed six dimensions, found also in theory and empirical health care studies. Conscience was perceived as authority, a warning signal, demanding sensitivity, an asset, a burden and depending on culture. We conclude that the Perceptions of Conscience Questionnaire is valid for assessing some perceptions of conscience relevant to health care providers. (shrink)

Incest is a crime in most societies. In the United States, incest is punishable in almost every state with sentences going as far as 20 and 30 years in prison, and even a life sentence. Yet the reasons traditionally proffered in justification of criminalization of incest—respecting religion and universal tradition; avoiding genetic abnormalities; protecting the family unit; preventing sexual abuse and sexual imposition; and precluding immorality—at a close examination, reveal their under- and over-inclusiveness, inconsistency or outright inadequacy. It appears that (...) the true reason behind the long history of the incest laws is the feeling of repulsion and disgust this tabooed practice tends to evoke in the majority of population. However, in the absence of wrongdoing, neither a historic taboo nor the sense of repulsion and disgust legitimizes criminalization of an act. (shrink)

Social animals need to share space and resources, whether sexual partners, parents, or food. Sharing is indeed at the core of social life. Humans, however, of all social animals, have distinct ways of sharing. They evolved to become Homo Negotiatus; a species that is prone to bargain and to dispute the value of things until some agreement is reached.

Our goal is to investigate the notion of self-agency in William James and Donald Winnicott. With James, we examine the descriptive element of what constitutes a self. With Winnicott, we explore his explanatory theory on self-emergence. Winnicott's perspective is presented here as the prehistory of the Jamesian self. James's conception of self is similar to the Winnicottian notion of an "integrated self", an embodied position that emerges from the organism's actions in the experiential field. The combination of the two approaches (...) leads to the idea that the self is a flux of identities emerging in interaction with others in the "transitional space" (an intermediate area of experience). I argue that curiosity about the world deserves attention as a moral virtue, even apart from the role it may play in (the more generally praised) love of wisdom. First, close relationships and caring are reasonably considered part of a well-lived life, and curiosity is important for caring both about people and about things in the world. Second, curiosity helps us to define an appropriate way for persons to be affected by certain situations. Perhaps most important, curiosity can help one (...) to live well because it addresses the most fundamental existential task humans face, the need to see their lives as meaningful. I argue that curiosity is a distinctive virtue but suggest that related virtues (e.g., receptivity, reverence) may contribute to different kinds of worthy engagement with the world. (shrink)

The object of this paper is to show how one is able to construct a paraconsistent theory of models that reflects much of the classical one. In other words the aim is to demonstrate that there is a very smooth and natural transition from the model theory of classical logic to that of certain categories of paraconsistent logic. To this end we take an extension of da Costa''sC 1 = (obtained by adding the axiom A A) and prove for it (...) results which correspond to many major classical model theories, taken from Shoenfield [5]. Desde la tradición de los estudios de gubernamentalidad y sus resonancias en las sociologías políticas y de la educación, en este artículo se recuperan los debates vigentes en torno a las nociones de gubernamentalidad, gobierno y biopolítica desarrolladas en la vasta obra de Michel Foucault y sus continuadoras/es para enlazarlas con las discusiones sobre el objeto de estudio y el campo teórico de la política educativa, enfatizando el potencial analítico que ofrece su grilla de inteligibilidad para los fenómenos educativos propios (...) de las sociedades posdisciplinares. En esa dirección, este trabajo esboza una serie de propuestas epistemológicas, teóricas y metodológicas producidas a partir de una investigación empírica recientemente finalizada (Aguirre, 2022), de corte descriptivo y de carácter cualitativo. En vistas a estos propósitos, se producen diálogos interdisciplinares a la vez que se tensionan y discuten algunos supuestos clásicos y tradicionales de la política educativa, para incitar una renovación analítica que posibilite el estudio de las relaciones sociales de autogobierno y gobierno de las/os otras/os en tanto articulaciones históricas entre el saber, el poder y la subjetividad. Finalmente, se exponen algunos indicios y propuestas para el abordaje sociológico de los fenómenos educativos contemporáneos, que convocan y promueven la necesidad de producir ciertos desplazamientos epistemológicos en el campo teórico de la política educativa, así como invitan a la reconfiguración de sus objetos de estudio en el marco de la adscripción a un enfoque posestructuralista.
